Haven't Checked If Your Invention Is Patentable Yet?

Filing secures your priority date, but it's worth confirming your invention is genuinely novel first. Our Patentability Check gives you an honest Yes/No verdict before you file – no upsell, no sales pitch.

Patent Basics

What Is a Provisional Patent, and Why File One First?

Most Indian MSMEs haven't heard of this option – and it's one of the most useful tools available to an inventor whose product isn't fully finished yet. Here's the plain-language version.

A provisional patent application is a simpler, faster first filing that locks in your priority date – the legal timestamp that determines whether your invention counts as new against anyone else who files later. It does not grant you a patent by itself. What it does is buy you 12 months to finish developing your invention and prepare a complete specification, while your place in line is already secured.

📅

Locks In Your Priority Date

India follows a first-to-file system – the earliest filer wins, not the first to invent. Filing now protects your place in line.

🗣️

Freedom to Talk About It

Once filed, you can present at conferences, exhibit at trade shows, or pitch investors without losing novelty in India.

🛠️

Time to Finish Developing

You don't need a finished product to file – a sufficiently detailed description of your invention is enough to secure the date.

🏷️

"Patent Pending" Status

You can start using the term Patent Pending immediately after filing, signalling protection to buyers and investors.

The Single Most Important Fact

The 12-Month Clock: No Extensions, No Exceptions

This is the one thing every applicant must understand before filing a provisional application.

This is why our plan includes deadline tracking and managed milestone reminders – so this date is never left to memory alone.

📋

Complete Coverage Audit

A quality & completeness audit by an IP process specialist, and review by the independent attorney you authorise, before filing – so a thin, rushed document is never what stands between you and protecting what you've built.

Why File a Provisional Patent First?

  • You've already put in the real work of creating something valuable – a rushed filing shouldn't be the reason you lose your claim to it.
  • Locks in your priority date at a lower upfront cost than jumping straight to a complete specification.
  • Lets you keep refining your invention while your place in line is already secured against later filers.
  • Gives you freedom to disclose your invention publicly in India – at trade shows, to investors, or in research papers – without losing novelty.
  • Provides real, credible "Patent Pending" status for your pitch deck, packaging, or marketing from day one.

Why One Complete Plan?

  • A cheap, thin specification is the real risk – if it doesn't properly describe your invention, the protection you paid for may not hold up when it matters.
  • Most providers charge separately for drafting, formality checks, filing and the strategy call.
  • Our Complete Plan is a single, transparent fee – no future surprises at any stage.
  • Every step is covered – novelty quick-check, drafting support, filing, and 12-month deadline tracking.
  • Managed end-to-end by our process team, together with the independent patent attorney you authorise.
Value Comparison

The Real Cost: Why Our Price Is Better

Our pricing is simple and honest. Our one-time, all-inclusive fee is the only fee you will ever pay for every step in the package.

The Fragmented-Fee Trap

Most patent professionals charge separately for drafting, the formality check, the filing itself, and any strategy consultation – so the "starting price" you're quoted rarely covers everything you actually need.

A rushed or thin provisional specification is one of the most common, costly mistakes inventors make – it can weaken the claims you're able to make later. If you've put real effort into creating something valuable, a bargain-bin document is the wrong place to save money: the question isn't whether the filing is cheap, it's whether the document actually covers what you built.

Our Complete Plan

A single, transparent one-time payment based on your entity type – no hidden charges, no future surprises.

Your filing is managed end-to-end by our process team, together with the independent patent attorney you authorise, including deadline tracking so the 12-month clock is never left to chance.

Is This Right For You?

Who This Plan Is For

We'd rather you buy this with a clear head than assume it's for everyone.

This Plan Is Right For You If:
  • Your invention isn't fully finished yet, but you need to lock in your priority date now
  • You're planning a launch, trade show, or investor pitch and want to disclose freely without risk
  • You're confident you can complete your full specification within the next 12 months
  • You want independent attorney support without the overhead of a traditional law firm
You May Not Need This If:
  • Your invention is fully finalised, with detailed claims and drawings ready – a complete specification filed directly may suit you better
  • You're not confident you can complete a full specification within 12 months – a provisional that lapses offers no lasting protection
  • You want to protect a brand name, logo, or product's visual appearance rather than how it works – see our TROM or Design Patent plans instead

How It Works

Your Filing Journey in 4 Stages

1

Stage 1: Order, NDA & Quick-Check

Place your order, sign our standard NDA, and share your invention details. As the applicant or inventor, you'll compile and furnish an Invention Disclosure Document (IDD) with supporting technical specifications – the raw material our attorney needs to draft your specification. We then run a prior art / novelty quick-check and a completeness audit before drafting begins.

2

Stage 2: Drafting & Attorney Review

We prepare your provisional specification, drawings and Form 1/Form 2 documentation, reviewed by the independent patent attorney you authorise – including your 1-on-1 strategy call.

3

Stage 3: E-Filing & Priority Receipt

Once finalised, we e-file your application with the Registry, and you receive your official priority receipt and application number – your priority date is now locked in.

4

Stage 4: 12-Month Tracking Begins

Your 12-month clock starts today. We track your deadline and send managed milestone reminders, so you complete your full specification on time, well before it's due.

FAQ

Frequently Asked Questions

What do I need to provide before you can start drafting?
As the applicant or inventor, you'll need to compile and furnish an Invention Disclosure Document (IDD) – a written description of your invention, along with any supporting technical specifications, drawings, or sketches you have. This is the raw material our attorney uses to draft your provisional specification; we guide you on what to include, but the underlying technical detail has to come from you.
Does filing a provisional application mean I have a patent?
No. A provisional application does not grant you any patent rights by itself – it only secures your priority date. Enforceable patent rights arise only after a complete specification is examined and a patent is actually granted, which happens later in the process.
What happens if I miss the 12-month deadline?
Your application is automatically deemed abandoned under Section 9(1) of the Patents Act, 1970. There is no extension and no revival mechanism – your priority date is permanently lost. This is exactly why our plan includes active deadline tracking and managed reminders.
What is the next step of action, developments once I complete the process of this Patent Priority Date?
Once your provisional application is filed and your priority date secured, your 12-month window begins. During this time, keep refining your invention and work towards your complete specification with fully drafted claims – the Claims Scope Strategy Consultation included in your plan helps guide this. As your deadline approaches, you'll need to file the complete specification to carry your application forward; our team sends managed reminders well ahead of time and can support you with that next filing stage when you're ready.

Note: Complete Patent Application (Full Specification Filing), Patent Office Objection or FER Reply & Procedure Steps, Patent Hearing Support & Further Procedure Steps, and Patent Ownership Transfer (Assignment & Recordal) are separate services from the Provisional Patent Process Management covered on this page, available independently once you reach that stage or when you need such process.
Is this the same as the Patentability Check service?
No, though they're closely related. Our Patentability Check gives you a detailed, standalone opinion on whether your invention is likely to be patentable, before you commit to filing anything. This plan includes only a lighter prior art quick-check to catch obvious conflicts, as part of actually filing your provisional application. If you want a deeper assessment first, consider starting with the Patentability Check.
Can I publicly disclose or demo my invention after filing?
Yes. Once your provisional application is filed in India, you can present at conferences, exhibit at trade shows, or pitch investors without losing novelty for your Indian filing. This is one of the most valuable practical benefits of filing early.
Does this plan include a TROM dashboard or login account?
No. TROM dashboard features are part of our separate Trademark Registration & Online Management plan. Your 12-month deadline is tracked by our team, with reminders sent directly to you, rather than through a self-service login portal.
What does the Fee-Lock Guarantee + Transparency Note actually cover?
It means the price you pay today is final for this filing – no stage-wise add-on charges. This guarantee covers your fee; it does not guarantee that a patent will ultimately be granted, since that depends on the full examination process that follows, well beyond this provisional stage.
Who represents me in dealing with the Patent Office?
ipronline.com is a technology platform and does not provide legal representation. Your specification is drafted and reviewed, and your application filed, by the independent patent attorney or agent you authorise.
Is ipronline.com a law firm?
No. ipronline.com is a technology platform providing process management, documentation and workflow tools in accordance with Indian IP procedures. When legal representation is needed, you independently engage authorised IP attorneys.
